Organizer Terms of Service

1. Eligibility & Application

To become a CoastBuzz organizer, you must be at least 18 years old, have legal capacity to enter into these terms, and provide accurate registration information including your business name, email, phone number, and payment details. CoastBuzz reserves the right to approve, reject, or suspend any organizer application at its sole discretion, without liability, and for any lawful reason.

You agree to keep your account details accurate and up to date at all times. Any changes to your business information must be communicated to CoastBuzz promptly.

2. Event Listings & Ticketing Rules

As an organizer selling tickets on CoastBuzz, you agree to:

• Provide truthful, accurate, and complete information about your events, including date, time, venue, capacity, ticket tiers, and pricing.
• Set ticket quantities that do not exceed the actual capacity of your venue.
• Ensure your events are lawful and do not infringe upon the rights of any third party.
• Keep your event information up to date and promptly notify CoastBuzz of any changes, postponements, or cancellations.
• Grant CoastBuzz the right to review, feature, or remove event listings at its discretion.

CoastBuzz is not responsible for verifying the accuracy of your listings; you are solely responsible for the information you provide and the successful delivery of your events.

3. Payments, Commission & Payouts

The ticket purchase amount is collected from buyers through our payment processor at the time of sale. You acknowledge and agree that you are directly responsible for the ticket prices you set and the delivery of the corresponding tickets and event access.

• CoastBuzz charges a commission of 10% of gross ticket revenue per order for use of the ticketing platform.
• Your earnings are the ticket revenue minus the applicable CoastBuzz commission and any valid transaction fees.
• Accumulated earnings are reflected in your organizer dashboard and are eligible for payout according to the payout schedule and any thresholds published by CoastBuzz.
• Payouts, once approved and disbursed, are final. It is your responsibility to ensure the payment account you provide is correct.

You are responsible for any taxes arising from your use of the Service and agree not to rely on CoastBuzz for tax, legal, or accounting advice.

4. Refunds & Cancellations

You are responsible for defining and honouring the refund and cancellation policies for your own events. CoastBuzz may process or facilitate refunds at its discretion where required by law or where a transaction is found to be fraudulent or erroneous. For cancelled or postponed events, you agree to cooperate with CoastBuzz in communicating with buyers and, where applicable, issuing refunds in line with your stated policy.

5. Prohibited Conduct & Fraud Prevention

You agree not to engage in, permit, or facilitate any of the following:

• Creating fraudulent purchases, fake buyer accounts, or fabricated order volumes.
• Purchasing your own tickets, directly or indirectly, to inflate sales figures or manipulate rankings.
• Scalping, reselling, or transferring tickets in a way that violates our policies or applicable law.
• Misrepresenting facts relating to your events, sales, capacity, or performance.
• Attempting to abuse, exploit, or circumvent CoastBuzz' commission, payout, refund, or dispute processes.
• Using another person's or business's identity to register or transact.
• Engaging in any activity that is unlawful, harmful, or violates the rights of CoastBuzz or any third party.

CoastBuzz reserves the right, without notice or liability, to suspend or terminate your account, withhold payments, forfeit balances, and report any suspected fraudulent or illegal activity to the relevant authorities. Your earnings may be withheld pending investigation of any suspected fraud, misuse, or violation of these terms.

6. Intellectual Property

The CoastBuzz platform, its branding, design, software, and content are the exclusive property of CoastBuzz. You grant CoastBuzz a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and promote your listings and event information for the operation and promotion of the Service.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CoastBuzz does not warrant that the Service will be uninterrupted, secure, or error-free, or that it will increase your attendance, ticket sales, or revenue.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COASTBUZZ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO OUR ACCEPTANCE, REJECTION, OR NON-DELIVERY OF YOUR EVENT, THE FAILURE OF YOUR EVENT, ANY THIRD-PARTY CONDUCT, OR YOUR USE OF THE SERVICE.

Our total aggregate liability for any claim arising out of or relating to these terms or the Service shall not exceed the amount of commission you have paid to CoastBuzz in the twelve (12) months preceding the claim, or KES 1,000, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless CoastBuzz and its officers, directors, employees, agents, and licensors from and against any and all claims, demands, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your use of the Service or your organizer account.
• Your events, listings, content, or ticket sales.
• Your breach of these terms or any applicable law.
• Claims made by buyers, attendees, venue owners, or authorities in connection with your events.
• Disputes between you and any buyer, vendor, or third party.

10. Termination

CoastBuzz may suspend or terminate your organizer account immediately, without prior notice or liability, for breach of these terms or for any lawful reason. Upon termination, your right to use the Service ceases immediately. You remain responsible for orders and obligations incurred before termination.

11. Governing Law & Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising out of or relating to these terms shall first be resolved through good-faith negotiation. If not resolved within thirty (30) days, the dispute shall be submitted to mediation in Mombasa, Kenya, and if unsuccessful, to the exclusive jurisdiction of the courts in Mombasa, Kenya.

12. Severability

If any provision of these terms is held to be unenforceable, it shall be treated as if it were not part of these terms, without affecting the validity of the remaining provisions.

13. Entire Agreement

These terms, together with the CoastBuzz Terms of Service and Privacy Policy, constitute the entire agreement between you and CoastBuzz regarding organizer ticketing and supersede all prior agreements, statements, or representations.
