1. Acceptance of Terms

By accessing, browsing, or using the CoastBuzz website ("Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

CoastBuzz reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

CoastBuzz is an online platform that provides information about events, restaurants, experiences, accommodations, and other activities on the Kenyan Coast. The Service includes:

• Event listings and discovery
• Restaurant and dining guides
• Experience and activity recommendations
• Accommodation listings
• Blog content and reviews
• Advertising and promotional services
• Business partnership opportunities

3. User Accounts

Certain features of the Service may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Notifying us immediately of any unauthorized access

CoastBuzz reserves the right to suspend or terminate accounts that violate these Terms.

4. User-Generated Content

4.1 Submissions

When you submit content to the Service (including event listings, reviews, comments, or business information), you grant CoastBuzz a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content worldwide.

4.2 Responsibilities

You represent and warrant that:

• You own or have the necessary rights to submit the content
• The content does not violate any third-party rights, including intellectual property, privacy, or publicity rights
• The content is accurate and not misleading
• The content does not contain harmful, offensive, or illegal material

4.3 Content Removal

CoastBuzz reserves the right, but has no obligation, to monitor, edit, or remove any content that violates these Terms or that we find objectionable for any reason.

5. Business Listings

Businesses that list events, restaurants, experiences, or accommodations on CoastBuzz agree that:

• All listing information must be accurate and up-to-date
• CoastBuzz is not responsible for verifying the accuracy of listing information
• CoastBuzz may modify or remove listings that violate these Terms
• Listings are subject to availability and may be removed at our discretion

6. Advertising and Sponsorships

Advertising and sponsorship services are subject to separate agreements. By purchasing advertising on CoastBuzz, you agree to:

• Provide accurate and non-misleading advertising content
• Comply with all applicable advertising laws and regulations
• Not advertise illegal, harmful, or offensive content
• Pay all fees as agreed in the applicable advertising agreement

CoastBuzz reserves the right to reject or remove any advertising content that violates these Terms or our content guidelines.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of CoastBuzz and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Transmit harmful, fraudulent, or deceptive content
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to the Service
• Scrape, crawl, or data-mine content from the Service
• Use automated means to access the Service without permission
• Impersonate any person or entity
• Collect personal information from other users without consent

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CoastBuzz does not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Information on the Service is accurate, complete, or current
• Events, businesses, or experiences listed on the Service will meet your expectations
• Third-party links or content are accurate or appropriate

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COASTBUZZ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from access to, use of, or inability to access or use the Service
• Damages resulting from any content or conduct of third parties on the Service
• Damages resulting from unauthorized access to your account

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid to CoastBuzz in the twelve (12) months preceding the claim, or KES 1,000 if you have not made any payments.

11. Indemnification

You agree to indemnify, defend, and hold harmless CoastBuzz and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Service

12. Third-Party Links

The Service may contain links to third-party websites or services that are not owned or controlled by CoastBuzz. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that CoastBuzz shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

13. Termination

CoastBuzz may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mombasa, Kenya.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to mediation in Mombasa, Kenya. If mediation is unsuccessful, the dispute shall be resolved through binding arbitration or litigation in the courts of Mombasa, Kenya.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CoastBuzz regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral.
